法官今天宣判時說，土豪哥開毒趴，轉讓毒品與小模死沒關係，依法醫研究所鑑定，小模
體內PMA濃度高達3.778，連胃部都有，小模顯然至少服毒4個月，而醫學上濃度只要0.2就
會致死，但在場的土豪哥等人，體內都沒這種毒，合議庭認定，小模死因與土豪哥開毒趴
及提供毒品無關，土豪哥不必為小模的死負責，但他開毒趴供毒，仍屬違反藥事法，判刑
2年10月。
依法醫研究所分析顯示，若在血液、膽汁及胃內採集到毒品反應，代表此人是短時間內服
用；如果是在頭髮化驗出毒品反應，而且毒物反應還遍布頭髮，則顯示當事人長期吃該項
毒品。而郭姓小模的頭髮被驗出長達4公分遍布PMA、Ethylone這2種毒品，但她的腸胃或
血液卻沒有Ethylone這項毒品反應，顯示郭姓小模吃Ethylone及PMA恐近半年，但在命案
現場可能沒施用。
一審及二審都不採信土豪哥見解，全案上訴最高法院後，合議庭終於採信，並提出小模生
前曾看腎科，應查明是否腎有問題而無法及時排毒致死，將全案發回更審，高院更審認定
，小模死因，是自主行為介入致死，輕判土豪哥2年10月，仍可上訴。
