因為隱匿掩蓋柴油排放造假案，美國有三個州起訴福斯相關涉案人士。
包括紐約州、麻州和馬里蘭州的檢察單位，同時起訴福斯集團幾十人(dozens)，
包括前任CEO Martin Winterkorn、現任CEO Matthias Muller、其他集團高層人士，
以及好幾個部門的負責人與造假裝置的工程師等人。
紐約州總檢察長Eric Schneiderman，批評福斯有一種深植在公司傲慢(思維)的企業文化
，這種傲慢讓他們心中覺得可以無視法治，可以忽視保護公眾健康和環境
他說,「一定要讓福斯付出鉅額罰款，罰款金額要高於它們賠償給美國消費者的總額。」
Eric Schneiderman, New York Attorney General, said the new claims
“reveal a culture of deeply rooted corporate arrogance, combined with
a conscious disregard for the rule of law or the protection of public health
and the environment. Substantial penalties must be imposed on the Volkswagen
companies, above and beyond the amount they have to pay to make American
consumers whole.”

雖然在事件爆發前，檢察官早在去年8月就已經下令不准銷毀文件資料，
但至少有八名跟研發造假裝置有關的福斯工程師仍違法刪除或移除罪證資料。
不過，在被刪除的文件當中，有一部份資料已經被偵辦人員復原救回來了。
檢方起訴書的內容顯示，福斯造假行動有十年以上的時間了。
排氣造假，前CEO Winterkorn早就知情，其他還有多名集團高層人士，
像是全球行銷總監Christian Klingler、好幾個部門的負責人也知情(directors)，
但他們卻不去補救改善。

而現任CEO Matthias Muller，雖然檢方沒有指控他知情，
但他在2006年擔任Audi管理高層的時候，就知道有某些柴油排氣方面的問題，
他曾做出最終決策，同意某些3.0TDI柴油引擎不要採用更大型的尿素桶，造成容量不足
而他也知道這項決策會影響到3.0TDI在面對美國排氣標準時的(環保)效能。
因此很明顯的，Muller是決策過程的一份子 (in the loop)。

The suits did not state Muller was aware of the violations.
Schneiderman told reporters Muller "was made aware of some aspects of this
problem" and that "he clearly was in the loop."
The New York suit said current CEO Matthias Muller, then head of project of
management at Audi, and Winterkorn became aware in July 2006 of the effect of
undersized urea tanks on the ability to comply with emissions standards.
The suit said VW opted to install defeat software instead of larger tanks to
save money.
