一群年輕人組成的《台灣民主人權平台》，日前爆前總統陳水扁9月一度病危，基於人道
、捍衛人權，發起「促請准陳前總統保外就醫、居家治療」活動。繼17日夜宿自由廣場後
，該團體今再至美國在台協會(AIT)遞交陳情書，希望美國以人權考量提供協助。
《台灣民主人權平台》約30名成員，今早10點許先至國際特赦人權組織台灣分會提出訴求
，之後再以徒步的方式至美國在台協會遞交陳情書，並高喊口號「保障醫療人權」、「還
扁居家治療」、「捍衛基本人權」等。現場約有20名警員築成人牆擋住門口，但並未發生
衝突，場面和平。
AIT官員雖出面接下陳情書，但有4名平台成員不願離去，坐在地上呼喊口號，他們認為應
要求AIT限時回應訴求，給予肯定答覆。(顏凡裴／台北報導)

Petition
To whom it may concern:
Shui-bian Chen, the former president of Taiwan, now at his sixty-four, with
his tremor, stutter and urinary incontinence, along with serious brain
degeneration, has been losing the ability of self-care and is almost
incapacitating. Being any other imprisoner of this situation, he would have
been granted medical parole long ago. It is because of his special and
sensitive status that he wasn’t be able to receive the basic right he
supposed to have.
Since the KMT retook control of the government, the government’s ignorance
to human right has been raising to the level almost as notorious as China and
North Korea. People are not treated as subjects, instead, they are merely a
chess in the game of the rulers. All of these human right fall backs can be
observed through government’s action toward protestors of Sunflower
Movement, and, among others, its treatment to former president Mr. Chen.
Taiwan has ratified International Covenant on Civil and Political Rights and
International Covenant on Economic, Social and Cultural Rights and
incorporated these two human right related covenants into its domestic law.
Pursuant to International Covenant on Civil and Political Rights Art. 7, “no
one shall be subjected to torture or to cruel, inhuman or degrading treatment
or punishment. In particular, no one shall be subjected without his free
consent to medical or scientific experimentation.” In addition, it is also
stated in Art. 10 that “all persons deprived of their liberty shall be
treated with humanity and with respect for the inherent dignity of the human
person.”
Therefore, we are acting to raise consciousness on this issue and to ask for
your help with Mr. Chen's deteriorating situation. We believe, it is by the
humanity treatment to our former president that we can really claim Taiwan is
a country of human right.

陳水扁總統，64歲，手抖、口吃、尿失禁，腦部功能急劇退化，完全失去生活自理能力，
近乎失能。換做另一位有著同樣疾患，並且身陷囹圄的人，可能早已獲得保外就醫，得以
居家治療。然而正因身分特殊，直至今日，他依然無法脫離被囚禁的生活。
自國民黨重新執政，對於人權的漠視，幾乎等於惡名昭彰的中國與北韓，人民從未被作為
主體對待，而是國家與獨裁者手中的一枚棋子。這些人權的衰退，可以從政府如何對待
318學太陽花運的抗爭民眾，以及如何對待陳水扁總統上看出。
臺灣，已經批准了《公民政治權利國際公約》，以及《經濟社會文化權利國際公約》這兩
大人權公約，其中，《公民與政治權利國際公約》於第7條規定：「任何人不得施以酷刑
，或予以殘忍、不人道或侮辱之處遇或懲罰。非經本人自願同意，尤不得對任何人作醫學
或科學試驗。」第十條規定：「縱屬自由被剝奪之人，仍應受合於人道及尊重其天賦人格
尊嚴之處遇。」
因此，透過行動來抬高對這個議題的意識，並在此請求你們為日漸衰弱的陳總統
提供協助。我們堅信，只有藉由一位前總統的人道醫療得以實現，我們才能宣稱台灣是一
個有人權的國家。
