我簡單做判決摘要，等等最後分析。
烏克蘭訴俄羅斯聯邦
訴之聲明：
(a) Adjudge and declare that, contrary to what the Russian Federation claims,
no acts of genocide, as defined by Article III of the Genocide Convention,
have been committed in the Luhansk and Donetsk oblasts of Ukraine.
裁定並公布：俄羅斯聯邦所宣稱違反日內瓦公約第三條的種族滅絕並未在烏克蘭發生。
(b) Adjudge and declare that the Russian Federation cannot lawfully take any
action under the Genocide Convention in or against Ukraine aimed at
preventing or punishing an alleged genocide, on the basis of its false claims
of genocide in the Luhansk and Donetsk oblasts of Ukraine.
裁定並公布：俄羅斯聯邦不得以其合法阻止種族滅絕為由的虛偽聲明對於烏東採取任何
行動。
(c) Adjudge and declare that the Russian Federation’s recognition of the
independence of the so-called ‘Donetsk People’s Republic’ and ‘Luhansk
People’s Republic’ on 22 February 2022 is based on a false claim of
genocide and therefore has no basis in the Genocide Convention.
裁定並公布：俄羅斯聯邦對於兩個人民共和國於2022/2/22獨立是基於錯誤的主張，因為
沒有違反日內公約的種族滅絕。
(d) Adjudge and declare that the ‘special military operation’ declared and
carried out by the Russian Federation on and after 24 February 2022 is based
on a false claim of genocide and therefore has no basis in the Genocide
Convention.
裁定並公布：2022/2/24俄羅斯聯邦所採取的「特殊軍事行動」是基於錯誤的種族滅絕主
張而失所附麗。
(e) Require that the Russian Federation provide assurances and guarantees of
non-repetition that it will not take any unlawful measures in and against
Ukraine, including the use of force, on the basis of its false claim of
genocide.
要求俄羅斯聯邦保證不會再基於虛無主張於烏克蘭境內採取任何非法措施，包括使用武力
。
(f) Order full reparation for all damage caused by the Russian Federation as
a consequence of any actions taken on the basis of Russia’s false claim of
genocide.”
要求俄羅斯賠償其因為錯誤主張所造成的所有損害。
然後應該是追加了這一點：
“pursuant to Article 74 (4) of the Rules of Court . . . to call upon the
Russian Federation to immediately halt all military actions in Ukraine
pending the holding of a hearing, to enable any order the Court may make on
the request for provisional measures to have its appropriate effects”
依據國際法院規約第74條第4項，要求國際法院院長暫時處分要求俄羅斯停止一切軍事行
為。
裁定主文：
1. 13:2：要求俄羅斯聯邦立刻中止其自2/24起的軍事行為。
2. 13:2：要求俄羅斯聯邦確保任何軍隊或軍人達成第一項的目的。
3. 無異議通過：雙方應終止任何可能加劇或擴大爭議的行動導致法院難以解決。
前兩項投反對票的法官為：
副院長 俄羅斯籍 Gevorgian 法官
中國籍 薛 法官
根據規定，十五名法官要來自不同法系，但事實上五常各佔有一席。
自1970年起為：非洲3名，拉美2名，亞洲3名，東歐2名，西歐及其它國家（包括加拿大、
美國、澳大利亞和紐西蘭）5名
心得：
誰能告訴我這要怎麼強制執行，然後本案還未終結，只是中間的暫時處分而已。

喔還有因為俄羅斯聯邦有一名法官，根據國際法院規約第31條第1項不用迴避，但是當事國
可以從候補法官名單中提一名加進去。
