The Chicago Cubs filed a federal lawsuit Tuesday against Wrigley View Rooftop, a
business that sells rooftop tickets in a building adjacent to Wrigley Field to
watch Cubs games and concerts, for what the team describes as unlicensed sales a
nd intellectual property theft.

The underlying controversy is not new. The Cubs and owners of adjacent buildings
have battled in court several times over those owners’ right to generate profi
ts from Wrigley Field events by virtue of their location. The team and owners st
ruck deals 20 years ago where the owners agreed to share about 17% of their reve
nue from out-of-stadium rooftop seats and 11% of billboard revenue with the Cubs
. In the subsequent years, the Cubs bought many of those properties, and deals w
ith the remaining owners recently expired.

In April, Crain’s Chicago Business reported that negotiations on a new contract
were problematic. Tim Cerney, an attorney for Wrigley View Rooftop owner Aiden
Dunican, was quoted as saying the Cubs demanded terms to increase out-of-stadium
rooftop seat revenue share to 30% and billboard revenue to 50%. The dispute als
o involves possible signage and screens that could block views from out-of-stadi
um rooftop seats.
