再送給各位關於維也納條約法公約(Vienna Convention on the Law of Treaties)的規定，
維也納條約法公約第52條：
「A treaty is void if its conclusion has been procured by the threat or use of
force in violation of the principles of international law embodied in the
Charter of the United Nations.」
翻譯成中文的意思是：「條約係違反聯合國憲章所含國際法原則以威脅或使用武力而獲
締結者無效。」
聯合國憲章第二條第一項第四款：
「All Members shall refrain in their international relations from the threat
or use of force against the territorial integrity or political independence
of any state, or in any other manner inconsistent with the Purposes of the
United Nations.」
「第四、各會員國在其國際關係上不得使用威脅或武力，或以與聯合國宗旨不符之任何
其他方法，侵害任何會員國或國家之領土完整或政治獨立。」
以現代國際法的規則，在武力威脅下締結的條約根本是無效的，
雖然馬關條約簽訂是遠在聯合國成立以前，沒有辦法援引。
但是中日和約第四條已經很明白的表明：
「中國與日本國間在中華民國三十年即公曆一千九百四十一年十二月九日以前
所締結之一切條約、專約及協定，均因戰爭結果而歸無效。」
所謂一切條約自然包括馬關條約在內，且中日和約日本早已簽字認可，
根本不容抵賴。
