Section 214(b) is part of the Immigration and Nationality Act (INA). It
states:
Every alien shall be presumed to be an immigrant until he establishes to the
satisfaction of the consular officer, at the time of application for
admission, that he is entitled to a nonimmigrant status...
To qualify for a visitor or student visa, an applicant must meet the
requirements of sections 101(a)(15)(B) or (F) of the INA respectively.
Failure to do so will result in a refusal of a visa under INA 214(b).
白話就是每個申請者都被假設「有移民意圖」，但只是假設，滿足一定條件後可
由簽證官推翻該假設，變成「不具有移民意圖」。簽證官在電腦上面輸入的東西
就是推翻該假設的理由。該條文特別列舉 B和 F種別簽證，但實際上應該包含 J
、 M等非移民身份。
因此被發 214(b) 很明顯就是拒簽(a refusal of a visa) 了，日後再申請美簽
時必須主動承認。
